The judicial department of Shanxi province has formulated a complaint handling system for judicial expertise practice activities.

According to the "Procedures for Handling Complaints of Judicial Expertise Practice" of the Ministry of Justice and the "Opinions of the Ministry of Justice on Further Strengthening the Handling of Complaints of Judicial Expertise", and in light of the actual situation of the whole province, the Shanxi Provincial Department of Justice has formulated the "Complaints Handling System of Judicial Expertise Practice Activities of Shanxi Provincial Judic Degree ").


There are six chapters, thirteen sections, thirty articles and eighteen document formats in the Work System, which are applicable to the handling of complaints about judicial expertise practice in the judicial administrative organs of the whole province. They are manifested in the following aspects. Firstly, it is clear that complaint handling should adhere to the guiding ideology of abiding by the law, seeking truth from facts, strengthening reasoning and emphasizing timeliness. At the same time, it should firmly establish the awareness of handling cases, evidence, rule of law, confidentiality and discipline. The second is to follow the principles of graded acceptance, investigation and punishment according to law, combination of punishment and education, and who accepts who handles who gives feedback. Thirdly, the process of handling complaints in forensic appraisal practice is divided into 10 steps, including receiving complaints, filling in the Registration Form of Complaints in Forensic Appraisal Practice, examining complaints, requiring additional materials from complaints, making decisions on acceptance, handing over complaints, forming investigation outlines and drawing relevant information. Business files and archives, analysis and research materials, investigation of the accused, investigation of relevant units and individuals, termination of complaint processing, order to stop illegal acts, handling, feedback and so on. Fourth, standardize the form of documents formed in every link of complaint handling. Eleven kinds of documents, such as "Notice of Acceptance of Complaints in Practical Activities of Judicial Expertise", formed in the process of complaint acceptance and investigation, are made by the judicial administrative organ's judicial appraisal management department on behalf of the organ. The documents formed in the process of complaint handling and feedback are handled by the judiciary. Government agencies. Fifthly, it is clearly stipulated that the judicial administrative organs should publicize the cases of judicial appraisal bodies and appraisers being subjected to administrative punishment, administrative treatment and professional punishment on the judicial administrative portal in a timely manner and push them to the people's courts at the same level. The provincial judicial department shall publish the administrative punishment, administrative treatment and industrial punishment of the whole province on the portal network of the judicial department and Shanxi Credit Network, and at the same time report it to the Ministry of Justice and inform the relevant departments.
